Let’s re-visit the matter of President Obama’s illegal and unconstitutional appointments to the National Labor Relations Board.
It’s been two months since a Federal Court ruled the three apointments made in January, 2012 by President Obama were unconstitutional. And, nothing has been done about stopping the board from hearing cases and making decisions. Oh, there are appeals. But the damage being done by the decisions made by the illegal and unconstitutional board continues unabated. And the illegal and unconstitutional appointees continue to hear cases and make decisions. What the hell is wrong with this picture? Even if the three people who have been ruled by a federal court to be illegally and unconstitutionally appointed actually believe their appointments were legal and constitutional, don’t you think they would have the common decency to “stand idle” until a final determination has been made by the United States Supreme Court? That’s most likely where the final decision is made. Are those three appointees so arrogant and self centered that they will continue to make decisions which do damage to people and businesses?
There are several problems in this matter.
First and most important. The president knew that these three appointments were illegal and unconstitutional before he made them. No matter how his “White House Counsel” or any other “legal eagles” spun the thing, they all, everyone of them, knew for certain that Congress WAS NOT in recess. The court, in its January, 2013 ruling, stated very clearly that only the Congress can determine when it is in recess. NOT the President. So, doesn’t it follow that the President has committed some illegal and unconstitutional act(s)? He lied to make the illegal and unconstitutional appointments. He cheated to make the illegal and unconstitutional appointments.
He stole to make the illegal and unconstitutional appointments. And there are three separate appointments. What happened to the President’s oath of office?
Second problem and just as important as the first. The Congress knew the apointments were, are, illegal and unconstitutional and did nothing about it. That makes everyone of the senators and representatives at least tacetly complicit in the illegal and unconstitutional acts. The driver of the getaway car in the bank robbery is just as gulity as the guy who went into the bank. Every damned one of them are guilty of violating their oaths of office.
Third problem and very serious. Every decision the NLRB made, or will make, during during the time of these three illegal and unconstitutional appointees are all, everyone of them, illegal. Don’t give a damn what anybody says. It is so simple. Every decision from January, 2012 is ILLEGAL. Therefore, everyone of the decisions cannot, must not, be enforced. It’s as if those decisions were never made. Regardless of how difficult it is to “undo” the problems caused by the illegal rulings. Just imagine the millions of dollars of costs to all parties as a result of the illegal decisions. Who is going to be responsible for making everbody whole again? How about all three of those illegal and unconstitutional appointees be held personally liable for all the money, emotional and all other damagescaused by their decisions? Take every dime they have or will ever have. Why not? They knew they were doing something illegal. I would take it even one step further. Charge and prosecute them for their illegal and unconstitutional activities. How about some prison time, too?
The fourth problem. Why did the two legally and constitutionally appointed members of the NLRB do any board business when they knew there were three illegally and unconstitutionally appointed members? Why didn’t either of them say, “Wait a minute. Let’s get this straightened out before we proceed.” Since neither of them are known to have objected, doesn’t that make them just as guilty of illegal and unconstitutional
actions? And just as responsible and liable for the damages they have assisted in causing?
This whole disgraceful and sordid mess is just one of many examples of how the government and a lot of individuals are stealing America. A President who is willing to deliberately lie, cheat and steal. A Congress which will deliberately do nothing to hold the President accountable. Appointees who are willing to deliberately act illegally and unconstitutionally to further their personal statuses. Democrats. Republicans. Other political organizations. All of them. Elected or appointed. All are guilty, some more than others, of participating in the destruction of America. And the current President and his “bunch” are leading the pack.
